Terms of Service

1. Acceptance of Terms

By accessing or using the Foliftplatform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users, including shippers and carriers.

2. Description of Service

Folift is a freight marketplace that connects shippers who need to transport cargo with carriers who have available truck capacity. The Service facilitates discovery, booking, payment escrow, live tracking, communication, and carbon reporting.

3. User Accounts

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account
• You must select a role (Shipper or Carrier) during onboarding
• You may add a second workspace role from within the app
• You must accept these Terms of Service to complete registration

4. Shipper Responsibilities

• Provide accurate cargo specifications including dimensions, weight, and declared value
• Ensure cargo is properly packaged and ready for pickup at the agreed time
• Disclose any restrictions, handling requirements, or hazardous materials
• Make payment through the platform's escrow system
• Confirm delivery upon receipt of cargo

5. Carrier Responsibilities

• Publish accurate route, capacity, and pricing information
• Maintain valid licences, insurance, and compliance documentation
• Handle cargo with appropriate care based on declared specifications
• Provide timely status updates throughout the shipment
• Complete delivery and obtain confirmation

6. Payments & Escrow

All payments are processed through our escrow system. When a shipper books freight space, funds are held securely until delivery is confirmed. Upon confirmation, funds are released to the carrier minus applicable platform and carbon offset fees.Folift is not responsible for disputes arising from cargo damage, delays, or non-delivery — though we provide tools for reporting issues and facilitating resolution.

7. Pricing & Fees

Carriers set their own prices for routes. All quotes include a transparent breakdown: base charge, pickup fee, EU carbon offset, and service fee. Platform fees are deducted from carrier payouts as shown in the payout breakdown.

8. Ratings & Reviews

Users may rate and review each other after completed shipments. Reviews must be honest and based on actual experience. We reserve the right to remove reviews that violate our community guidelines.

9. Limitation of Liability

Foliftacts as a marketplace platform connecting shippers and carriers. We are not a freight carrier and do not take possession of cargo. Our liability is limited to the extent permitted by applicable law. We do not guarantee the availability, quality, or timeliness of any carrier's services.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, active shipments must be completed and outstanding payments settled.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Berlin, Germany.
